The Education Appeal Tribunal functions as a board independently of the government. It may hear appeals of decisions made by departments, schools or school councils. This includes decisions affecting special needs students, suspensions, student records and locally developed courses of study.
The appeal tribunal hears appeals from parents and students who want to go beyond the Department of Education to resolve a dispute. To determine the outcome of an appeal, the appeal tribunal considers:
- the educational interests of the child:
- the impact on all other students; and
- any other relevant factors.

How members are selected
Members are appointed by a Minister, Cabinet or the Legislative Assembly.
School board and school council members can be elected or, in some cases, appointed.
Appointments to these boards are based on standing committee recommendations:
- Yukon Development Corporation
- Yukon Energy Corporation
- Yukon Workers' Compensation Health and Safety Board
- Yukon Lottery Commission
- Yukon Recreation Advisory Committee
- Yukon Arts Advisory Council
- Yukon Utilities Board
- Yukon Council on the Economy and the Environment
- Yukon Human Rights Commission
Some boards and committees members are required to hold certain professional qualifications or affiliations.

Once the tribunal receives an appeal the following steps will happen:
- the appeal will be confirmed to be valid or invalid under the provisions of the Education Act
- provides a copy of the written appeal and a summary to all included parties, this includes the Department of Education within five days;
- provides the department an opportunity to respond in writing to the appeal within seven days; and
- determines a date and time for a pre-hearing conference.
During a pre-hearing conference, the tribunal will:
- confirm the tribunal’s jurisdiction to hear the appeal; and
- determine if there is an opportunity for resolution before a formal hearing. This may include a mediator.
What if an agreement is not reached?
- if no agreement is reached, the matter will proceed to a formal hearing
- decisions made during a formal hearing of the Education Appeal Tribunal are binding and are filed in the Yukon supreme court
