New regulations for the Condominium Act, 2015 will come into force on October 1, 2022.
The new legislation provides additional rights and protection measures for buyers, owners and renters of condominiums, as well as provisions that ensure responsible development and governance of condominiums in the Yukon.
Pre-existing condominiums and those created after October 1, 2022, will have different requirements under the new Act:
- Pre-existing condominiums will experience a transition period for a number of requirements, including reserve funds, insurance, bylaws and new financial provisions.
- Condominium corporations that are incorporated after October 1 will need to meet all requirements of the Act immediately. More information on these timelines can be found in the timeline infographic.
The Government of Yukon held information sessions on these changes in July 2022 for condominium developers and in September 2022 for condominium corporations. Public engagement on the condominium regulations has been ongoing since late 2018. This work helped inform both regulations and amendments to the legislation. Further information and resources, such as fact sheets, forms, frequently asked questions, links to legislation and any upcoming information sessions, can be found on yukoncondos.ca.
This modern condominium legislation will ensure that developers, buyers, renters and owners have clear rights and responsibilities. Thank you to the Land Titles Modernization Stakeholder Advisory Committee for their work to make this legislation a balanced and informed framework that aligns the Yukon’s condominium legislation with other Canadian jurisdictions.
