You can apply to lease land for a quarry.
Eligibility
To be eligible for a quarry lease, you must be:
- a registered business; and
- in good standing with Yukon Corporate Registries.
Choosing a site
You can use the Yukon Lands Viewer to identify and select a proposed location for your project.
Ensure the land is available and does not overlap:
- Settlement Land;
- a titled parcel; or
- other conflicting uses.
You can get help with the lands viewer at:
- a Compliance, Monitoring and Inspections office; or
- the Land Management Branch located at 320-300 Main Street in Whitehorse. Our office is open Monday through Friday from 8:30 am to 4:30 pm.
Quarry sites must be:
- within 1 kilometre of a road maintained year-round, as listed in Schedule 1 of the Highways Act;
- at least 30.48 metres away from a lake or river and 10 metres away from a creek; and
- outside an area currently undergoing local area planning.
Ensure your site meets the criteria in our commercial and industrial land policy.
Apply for your lease
- Download, complete and sign the application form.
- Include with your application:
- a detailed, to-scale site plan for the entire site;
- a location map;
- an operation and rehabilitation plan;
- a copy of your business licence;
- a copy of corporate registry, if applying as a corporation or limited partnership;
- if the site is located within a municipality, a letter from the municipality stating that the site and use complies with municipal plans and zoning; and
- a business plan – read our business guidelines to see what to include.
- We recommend you review your application with our staff. We can help ensure your application is complete and the land you chose is suitable. You can visit us at:
- a Compliance, Monitoring and Inspections office; or
- the Land Management Branch, located at 320-300 Main Street in Whitehorse. Our office is open Monday through Friday from 8:30 am to 4:30 pm.
- Submit your application with an application fee of $25 plus 5 per cent GST. You can do this when you meet with our staff to review your application.
Timeline for decision
Review of your application includes consultation with First Nations and public engagement. You may require an environmental and socioeconomic review by the Yukon Environmental and Socio-economic Assessment Board. We'll tell you if you need to complete a designated office assessment.
It typically takes 6 to 12 months to reach a decision on your application. Throughout the process, we'll be in touch:
- to keep you up to date on the progress of your application; and
- if we need clarification.
After you receive our decision
- After we make a decision about your application, we'll mail you a decision letter.
- If we approve your application, we'll mail a lease document to you to sign.
- You return the lease document and pay the annual lease fee stated in your lease.
- We sign the lease and provide you with a final copy for your records.
- We also provide you with a quarry permit for the coming year.
If we deny your application
We'll notify you in the decision letter. You can appeal the decision.
Each year, you need to:
- file a return telling us how much material you've removed;
- pay a royalty on the material; and
- pay your annual lease fee.
When you submit your return, we'll issue you a new quarry permit for the upcoming year.
Royalty fees
Topsoil: $1 per cubic metre.
All other material: $0.25 per cubic metre.
Lease fee
The lease fee is based on the value of the land. You can find your annual lease fee in your lease document.
Deadline
Your royalty return and payments are due annually in November. We'll mail you a reminder notice in October.
Pay your royalty return and lease fee
You can pay by cash, cheque, debit, credit card, or money order.
Submit your return to:
- a Compliance, Monitoring and Inspections office; or
- the Land Management Branch, located at 320-300 Main Street in Whitehorse. Our office is open Monday through Friday from 8:30 am to 4:30 pm.
You can close your quarry if you’ve:
- extracted all the material you need;
- exhausted the supply of material; or
- stopped operations temporarily.
Temporary closure
If you're closing your quarry temporarily, you must:
- protect the quarry from erosion;
- ensure no drainage issues will arise; and
- treat contaminated soils.
Permanent closure
If you're closing your quarry permanently, you must follow your reclamation plan. This includes:
- removing all garbage and debris;
- controlling erosion;
- treating any any contaminated soil;
- meeting any requirements for seeding, planting or fertilizing; and
- reclaiming the road and access.
